The Project, Project Idea Note or Expression of Interest Applicant (“Participant”), through this Adhesion Term, hereby declares to be fully aware of and assume completely all responsibilities herein set forth:

The Participant hereby agrees to properly complete the initial registration form and, subsequently, if approved, to then register all pertinent project data in the BM&F Carbon Facility through the completion of the participant, project and expression of interest (EOI) registration forms available online at the BM&F and BVRJ websites. The Participant also assumes full responsibility for the accuracy, thoroughness and reliability of the information provided, as well as for keeping that information up to date.

Also with regard to participant, project and EOI registration, the Participant hereby agrees that the BM&F Carbon Facility may, at its sole discretion, refuse any submitted proposal without having to specify the reason as to why such decision was made.

The Participant also assumes full responsibility for the login and password provided by BM&F and BVRJ for the participant’s identification and access to the Carbon Facility, as well as the sole responsibility for maintaining both under extreme confidentiality.

The Participant hereby acknowledges that the BM&F Carbon Facility shall not accept liability (i) for any incompatibility between its system and the computer, modem and/or other communication equipment and software utilized by the Participant; (ii) for any omission, inaccuracy, delay, interruption, or any other type of failure in the services caused by the computer, modem and/or any other communication equipment or software utilized by the Participant, or by the improper use of the aforementioned equipment; and (iii) for the Participant’s negligence as regards the utilization of the system.

The Participant also hereby acknowledges the understanding that the BM&F Carbon Facility has no prior control over and does not guarantee the absence of viruses in the contents registered by third parties or of any other harmful elements which may lead to alterations in the Participant’s computer system (software and hardware) or in the electronic documents and files stored therein.

Lastly, the Participant hereby acknowledges that the contents available on the BM&F Carbon Facility have a merely informative purpose, and the BM&F Carbon Facility does not guarantee or in any way secure the accuracy and functionality of the contents disclosed in its web pages, nor does it provide any guarantee of the suitability of this information for any particular purpose.
